Spot the difference
This time, we would like to offer you a bit of a pass time of the kind you are likely to find in your favourite crosswords magazine, something like "spot the difference". We'll do this by submitting two essentially different drawings in fact, moreover done in different times and by a different hand: they are two very similar explorers nonetheless, the first, purposely not more than a sketch, the other, the fair copy. And as will happen in the best of quizzes, we'll also give you a "bit of a hand" on the differences: in the first drawing the "bell housing" faces the stern, in the other it faces the bow. And now, you spot the rest... You can't find any others? Well we also had some difficulty. Game play apart, we can explain. The first of the two drawings made a repeated appearance on various 2005 Superyacht issues. It is "our very own explorer", the one that came about as a result of a brainstorming session between us and "YDesign", a team of professional designers. A number of articles resulted from that very meeting, which attempted to explain the intricacies leading up to the actual production of a project, from start to finish also including a true definition of concept design. That is where our own explorer came from. The other drawing appeared on another specialized magazine in March 2007 attributing the "brain child" to another designer. The striking similarity between the two, has pushed us to dig a little deeper on the aspects of "Intellectual Property" and we have therefore given ample space in this edition to asking the opinion of some of the more established Italian yacht designers who often "bare and brunt" such similarities, just as we did. Finally, we asked an expert what the law states on the matter of similarities and he has written an article in an attempt to throw some light on the subject. This will probably not settle the everlasting matter as to how to protect an idea, a project, but it seems only right to us that the matter should at least be discussed, that information should flow, inviting all those wishing to intervene on the matter to do so. ( Fabio Petrone )
